Let’s talk about the negotiation and settlement phase of a personal injury claim. Can you walk us through what typically happens?
Certainly. After we’ve thoroughly investigated the incident, gathered evidence, and documented your damages, we move into the negotiation phase. Our goal is to reach a fair settlement with the insurance company representing the at-fault party. This involves presenting them with a comprehensive demand letter outlining the details of the accident, your injuries, medical expenses, lost wages, and pain and suffering.
Negotiations can be complex and often involve back-and-forth discussions. The insurance company may initially offer a lower settlement than what we believe is fair. We meticulously analyze their offer, taking into consideration all factors and legal precedents. If the initial offer is unacceptable, we continue to negotiate, presenting strong counterarguments and evidence supporting our client’s claim.
Notwithstanding these efforts, sometimes an amicable agreement cannot be reached through negotiation alone. In those cases, we may recommend mediation as an alternative dispute resolution method. Mediation involves a neutral third party who facilitates discussions between us and the insurance company to help reach a mutually acceptable settlement.
Have you ever encountered any difficulties during the negotiation stage?
There have been instances where negotiations became particularly challenging. I recall one case involving a client who suffered a severe back injury in a car accident. The insurance company initially offered a significantly low settlement, claiming the injuries were not as serious as we asserted.
We presented them with compelling medical evidence, expert testimony from specialists, and documentation of our client’s ongoing pain and suffering. It took several rounds of negotiations, but ultimately we were able to secure a settlement that adequately compensated our client for their losses. That case reinforced the importance of persistence and unwavering advocacy for our clients.
It’s important to remember that according to the Insurance Research Council, only about 4% of personal injury cases go to trial. This highlights the effectiveness of negotiation and settlement in resolving these matters fairly.
