An Interview With Ted Cook

Today we’re sitting down with Ted Cook, an elder protection attorney here in sunny San Diego. Ted, thanks for taking the time to chat with me.

What sparked your passion for elder protection law?

“You know,” Ted starts, leaning back in his chair with a thoughtful smile, “it wasn’t one singular event. It was more of a gradual realization. Early in my career, I saw firsthand how vulnerable older adults can be to exploitation and abuse. Whether it’s financial scams, neglect, or even physical harm, they often lack the resources or capacity to protect themselves. That’s when I knew I wanted to dedicate my practice to advocating for their rights and ensuring their well-being.”

Let’s delve into the process. Can you walk us through the steps involved in elder protection?

I’m particularly interested in learning more about ‘Protective Actions.’

Ted nods enthusiastically, “That’s a critical stage where we take immediate steps to safeguard the elder’s well-being. Depending on the situation, this might involve:

  • Filing for restraining orders or protective orders against abusers.
  • Notifying Adult Protective Services (APS) so they can investigate and intervene.
  • Seeking guardianship or conservatorship if the elder is unable to make their own decisions.

We also focus on financial protections, such as freezing bank accounts, revoking power of attorney that’s being misused, or preventing unauthorized property transfers. In some cases, we might even need to facilitate a transfer to a safer living environment, like an assisted living facility or nursing home.”

But through persistent communication and legal pressure, we were able to reach a resolution that protected the father’s assets.” Ted shakes his head slightly. “It’s not always easy, but seeing elders regain their safety and dignity makes it all worthwhile.”
