Interview with Steve Bliss, Wildomar Estate Planning Attorney

Setting the Stage

Good morning, Wildomar! I’m Brenda Sanchez reporting live today from the heart of our community. Joining me is none other than Steve Bliss, a respected estate planning attorney right here in Wildomar. Steve, thank you so much for taking the time to chat with us today.

The Importance of Selecting an Executor or Trustee

Steve, many people put off estate planning, thinking it’s something they can deal with later. Can you explain why choosing an executor or trustee is such a crucial step in the process?

You’re absolutely right, Brenda. Estate planning often gets pushed aside, but it’s truly one of the most important things you can do for your loved ones. Selecting the right person to act as your executor or trustee is paramount. This individual will be responsible for managing your assets, paying your debts, and ultimately distributing your property according to your wishes after you’re gone.

Consequently, choosing someone trustworthy, organized, and capable of handling these responsibilities is essential. It can be a family member, a close friend, or even a professional trustee. I always advise clients to consider factors like financial literacy, communication skills, and the ability to remain impartial during what can be an emotionally challenging time.

Think about it this way: would you want someone who’s easily overwhelmed with paperwork and decisions handling your estate? Conversely, choosing a meticulous individual who communicates clearly and understands your wishes will ensure your legacy is managed responsibly.

Moreover, remember that the executor or trustee will have significant legal authority. They’ll need to file necessary court documents, manage bank accounts, and potentially sell property. It’s crucial they understand these obligations.

Notwithstanding these considerations, sometimes disagreements arise within families about who should serve as executor. I’ve seen situations where siblings have differing opinions, leading to conflict and delays in the probate process. Ultimately, open communication among family members is key to avoiding such issues.

A Personal Touch

I remember one case where a client chose their eldest son as executor, assuming he was the most responsible choice. However, the son turned out to be overwhelmed by the task and struggled with making important decisions. Ultimately, we had to involve another family member who was more equipped to handle the responsibility.

That experience highlighted the importance of carefully considering not just who you trust but also who possesses the necessary skills and temperament for the role.

The Need for Ongoing Review

It’s estimated that over 50% of Americans do not have a will or estate plan in place, according to a study by Caring.com. This can leave loved ones facing significant legal and financial challenges.

Accordingly, I encourage everyone to take proactive steps towards securing their future and protecting their families. Regularly reviewing and updating your estate plan is crucial as circumstances change throughout life – births, deaths, marriages, divorces, and changes in assets all necessitate adjustments to ensure your wishes are carried out
