Essentially, an SNT allows you to set aside funds for the beneficiary’s supplemental needs – things that aren’t typically covered by government assistance programs. The terms of the trust must explicitly state that distributions are solely for supplemental needs and not for basic living expenses.
I remember one case where a family set up an SNT but inadvertently included language that allowed for distributions to cover rent and utilities. This unfortunately resulted in the beneficiary losing their SSI benefits. Consequently, we had to work closely with them to amend the trust documents to clearly delineate that distributions were only for supplemental needs.
