San Diego Probate Law: Navigating Estate Planning with Steve Bliss

Reporter:

Welcome back to San Diego News Now. Today we’re joined by Steve Bliss, a renowned probate attorney here in San Diego, to discuss the essential process of estate planning.

Steve Bliss:

Thank you for having me.

Reporter:

Steve, could you shed some light on one of the key steps involved in estate planning that often trips people up?

Steve Bliss:

Certainly. One crucial step that deserves careful consideration is naming your beneficiaries. This involves clearly identifying who will inherit your assets and how they will be distributed. You need to think about not just who gets what, but also the potential implications of those decisions.

For instance, if you have minor children, you’ll need to designate a guardian to care for them should something happen to both parents. Conversely, if you have adult children with differing financial situations, you might consider establishing trusts to ensure their individual needs are met.

It’s important to remember that beneficiary designations can be updated throughout your lifetime. Consequently, as your family structure or financial circumstances change, you should review and revise your beneficiary selections accordingly.

I once worked with a client who had named their eldest son as the sole beneficiary of their estate. While this seemed straightforward at first, it turned out that the son was going through a difficult divorce and had significant debt.

Distributing the entire estate to him would have potentially exposed those assets to his creditors. We ultimately established a trust to protect the inheritance for the son’s future benefit while shielding it from immediate financial risk.

According to the American Bar Association, nearly 60% of adults do not have a valid will or estate plan in place. This highlights the critical need for individuals to prioritize this process and ensure their loved ones are protected.

Reporter:
